Cincinnati-based Kroger reached a confidential settlement with C&S Wholesale Grocers.

New Jersey-based C&S sued in March, claiming it was owed a $125 million termination fee after Kroger’s proposed merger with Albertsons fell through, preventing C&S from acquiring nearly 600 stores that the two grocery giants planned to sell off.

Lawsuits between Albertsons and Kroger over the failed merger are ongoing.
